Max and Bob, aged four, were said to be in danger of being put into foster care over the festive season after reports that Child Protective Services were presented with mystery evidence revealing major inconsistencies in 36-year-old Mueller’s drug treatment program.
However, 48-year-old Sheen's other ex-wife, Denise Richards, has reportedly stepped in to rescue the boys once again and is willing to give them a second chance.

'Denise reached out to DCFS and said under no circumstances does she want Bob and Max to be placed in foster care,' a source told RadarOnline.com. 'Social workers
were impressed with Denise’s commitment to the boys.
'If the boys were to come back to Denise, she said they would have to be properly tested and assessed for their behavioral issues. She never wanted to give the boys up, but Brooke refused to allow them to be seen by doctors,” a source close to the situation told Radar.
Troubled Brooke's brother, Scott Mueller, had been granted temporary guardianship of the boys after the 42-year-old Denise was forced to give them up following alleged violent outbursts against her own daughters and their pets.

However, after RadarOnline.com reported that the short-lived family stability is already in peril, she apparently offered to step in to help.
'There is a very real possibility that Bob and Max could be placed in foster care because evidence was also uncovered regarding their temporary guardian, Scott, that is riddled with glaring differences in version of events,' a source close to the situation had told Radar.
'The department is taking this very seriously, and are considering recommending the boys be placed in foster care, pending the outcome of the investigation.

'Charlie can’t get custody of the boys, even if he were to have round-the-clock nannies because of his past behavior,' explained the insider.
'Brooke’s parents won’t be considered. It’s such a sad situation, but the safety and well-being of the boys comes first. Such drastic action wouldn’t be taken unless it was necessary, and sadly, it is.'
Starship Troopers star Richards was forced to give up the twins because of their alleged violent behaviour towards her daughters, Sam, Lola, and Eloise, and in a distressing letter to child protective services, she explained the harrowing situation.
According to Denise, her 'daughters have been strangled, kicked in the head and stomach, scratched, bit, slapped, punched in the face and head, and spit on' by the boys, as have the family dogs, reported Radar.

Now DCFS can go to court 'at anytime and ask the judge to strip Scott Mueller of temporary guardianship, and placed in foster care. It’s a very, very real possibility,' claims Radar's legal insider.
'The agency is looking at all options for the boys placement, and Denise could save them from living with strangers.'

The latest revelations come after it was reported that the Anger Management star won't be held in contempt of court for repeatedly violating a gag order in the acrimonious custody case.
TMZ revealed on Tuesday that a private hearing took place that day at which Mueller stated she didn’t want to take the matter any further, so the judge dropped the issue.
The website claims the judge will be granting Charlie two monitored visitations with his twins for two hours each.
Sheen’s custody will apparently be returned to 50/50, providing he receives good reviews from the Los Angeles County Department Of Children And Family Services.

Brooke, who was married to the Eight Men Out star from 2008 to 2011, had lost custody of Bob and Max earlier this year after being placed on an involuntary psychiatric hold stemming from a drug overdose.
The Los Angeles County of Department of Children & Family Services is set to go before a judge in child dependency court on Thursday, requesting an administrative hearing to be scheduled based on the new information presented to the agency.
Mueller is required to be in court, but sources say Sheen isn’t expected to attend.

It was previously revealed that Sheen could face jail time if Mueller asked the judge to sanction him.
'Really, they're going to jail me for telling the truth,' the actor said last month in response. 'If I actually go to jail for talking, I'll do interviews in jail.'
'He [the judge] wants to put me in jail for trying to save my boys? Go for it, fatty. I'll eat his lunch from jail... One meal he could afford to miss.'
